Following the publication by the Ministry of Justice of the response to its consultation on ‘Implementing increases to selected Court and tribunal fees’, the Court and Tribunal Fees (Miscellaneous Amendments) Order 2024, SI 2024/476 has been issued detailing the increase in selected Court and tribunal fees including in certain family proceedings and with increases also in relation to various Court fees for civil proceedings.

In the government’s response to its consultation on implementing increases to selected Court and Tribunal fees, it announced that it has elected to proceed with a 10% fee increase.  However the divorce application fee will not be increased nor will 29 further fees as further analysis is still required. Additionally, the government has undertaken to update fees every two years with the next fee review to take place in 2025–2026.

The new fees are highlighted in bold with the previous fees in brackets.

Matrimonial and civil partnership proceedings

On presenting an application for a matrimonial or civil partnership order, other than an application for a divorce order, a nullity of marriage order, a dissolution order or a nullity order or an application to which FPR 2010, SI 2010/2955, r 7.4(1)(b) applies, or on presenting an application for a declaration to which FPR 2010, SI 2010/2955, Pt 8, Ch 5 applies—£402 (£365)

Private law children proceedings

The fees for most private law applications under the Children Act 1989 are increasing including, among others, applications for:

  • a parental responsibility order—£255 (£232)
  • a parental order—£255 (£232)
  • a child arrangements order, specific issue order, or prohibited steps order—£255 (£232)
  • a guardianship order—£255 (£232)
  • an order under Children Act 1989, s13 for a change of child’s surname or removal from the jurisdiction while a child arrangements order is in force—£255 (£232)
  • a special guardianship order—£255 (£232)
  • an enforcement order under Children Act 1989 or an order for compensation for financial loss, due to the breakdown of a child arrangements order—£255 (£232)
  • an order to revoke, amend, extend or take action following the breach of an existing Children Act 1989 enforcement order—£112 (£102)
  • the amendment of an enforcement order by reason of change of address—£77 (£70)

Financial orders

Financial orders including:

  • application on notice for a financial order other than by consent—£303 (£275)

Enforcement in the Family Court

Certain fees for enforcement in the Family Court have increased including, inter alia:

  • an application for an order for such method of enforcement as the Court may consider appropriate—£59 (£54)
  • an application for an attachment of earnings order—£37 (£34)
  • an application for a charging order—£42 (£38)
  • an application for a judgment summons—£80 (£73)
  • an application for a third party debt order or the appointment of a receiver by way of equitable execution—£85 (£77)
  • an application for or in relation to enforcement of a judgment or order by the issue of a warrant of control against goods except a warrant to enforce payment of a fine—£110 (£100)
  • on the issue of a warrant of possession or a warrant of delivery—£131 (£119)

Public law children proceedings


The fees for some public children proceedings have increased, including, inter alia, applications for the following orders:

  • under Children Act 1989, s31 (care and supervision orders)—£2,437 (£2,215)
  • an emergency protection order under Children Act 1989, ss44, 45 and 46—£255 (£232)
  • an order for contact with a child in care under Children Act 1989, s34(2)–4), (9)—£255 (£232)
  • an education supervision order under Children Act 1989, s36(1)—£255 (£232)
  • variation or discharge of a care or supervision order under Children Act 1989, s39—£255 (£232)

Adoption proceedings


Certain applications in adoption proceedings, including inter alia

  • applying or requesting permission to apply under any provision in Part 1 of the Adoption and Children Act 2002 (ACA 2002), other than an application under ACA 2002, s 22—£201 (£183)
